Sheriff's Deputy Involved In Drug Warrant Shooting Injured By Fellow Officer's Bullet

Investigators say a gun shot suffered this past week by a Shelby County Sheriff's Deputy was caused by a bullet from one of his fellow officers.
“For the past few days we have examined the facts of this case with great detail. Although complete forensic and ballistic reports are still being compiled, we have determined the bullet that injured Deputy Jason Pagenkopf was not fired from the suspect's weapon,” said Shelby County Sheriff Mark Luttrell, Jr.
S.W.A.T. Officer Jason Pagenkopf was shot in the neck on January 26, 2004, as he and fellow officers served a narcotics warrant at a south-east Memphis apartment. Another deputy was also shot.
During their search, deputies were fired upon by 22 year-old Tab Virgil. Three bullets from Virgil's gun struck S.W.A.T. Officer Chris Harris. Virgil has been charged with Attempted First Degree Murder and may face additional federal gun charges.
Investigators, however, say the bullet that struck Deputy Pagenkopf is believed to be from a 40 caliber firearm. This is the type of gun used by officers with the Shelby County Sheriff's Office. Virgil was firing a 9 mm handgun.
Deputies reported that when they entered the apartment to serve the drug warrant, Virgil hid in a bedroom closet. Investigators say as officers moved towards the closet, Virgl started shooting.
When officers returned fire, it is believed one of the bullets went through the bedroom wall and stuck Officer Pagenkopf. Deputy Pagenkopf was released from the hospital just a few hours after the shooting.
“Anytime there is gunfire in a cramped environment, and many people are firing weapons, there is a chance of someone being hit by a stray bullet. We are thankful Deputy Pagenkopf and Deputy Harris have been released from the hospital and are recovering from their injuries,” added Sheriff Luttrell.
